1. The agreement

These terms are an agreement between you and [LEGAL ENTITY NAME] ("we", "us") about the myFriday app and this website. By using either, you agree to them. If you don't agree, please don't use them.

2. Who can use myFriday

You must be at least 13 years old. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you. To use your own API key, you must also meet your AI provider's own age and eligibility rules.

3. Your license

We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as the App Store's Usage Rules allow. You may not copy, modify, distribute, sell or lease the app, or reverse engineer it except where the law allows. We keep all rights we don't expressly give you.

4. Your API key and provider charges

  • You choose the AI provider (Anthropic or OpenAI), create the key, and agree to that provider's terms. Your relationship with the provider is separate from your relationship with us.
  • You're responsible for every charge your provider bills to your key, including usage the app makes on your behalf.
  • The spend cap in the app is a safeguard based on the app's own estimate of usage. It may not match your provider's bill exactly, and it isn't a guarantee. Set limits in your provider's console too.
  • Keep your key secure. If you think it's exposed, revoke it with your provider. We will never ask you for it.

5. AI output can be wrong

The assistant uses AI models made by other companies. Their output can be inaccurate, incomplete or out of date, and they can misread your calendar, tasks or messages. Check anything important before you act on it, especially dates, amounts, names and anything you send to other people. Drafts are suggestions. You're responsible for what you send.

6. Not professional advice

myFriday is a personal productivity tool. It doesn't give medical, legal, financial, tax or other professional advice, including when it reads Health data or helps you plan. For those, talk to a qualified professional.

7. Acceptable use

Don't use myFriday to:

  • break the law or violate anyone's rights;
  • harass, spam or deceive people, including by turning drafts into bulk messages;
  • break your AI provider's usage policies;
  • interfere with, overload or get unauthorized access to the app, this website or the waitlist;
  • access other people's data without their permission.

8. Purchases and subscriptions

  • Paid plans are sold through the App Store, and Apple's terms apply to payment.
  • Pro subscriptions, monthly or yearly, renew automatically unless you turn off auto-renew at least 24 hours before the current period ends. Manage or cancel them in your Apple account settings.
  • Refunds are handled by Apple under its policies.
  • Founding Lifetime is a one-time purchase that unlocks Pro features for as long as we offer the app, with no subscription. It doesn't include AI usage, and it doesn't include the Managed plan.
  • The Free plan's 7-day AI trial uses your own key, so provider charges during the trial are yours.
  • Prices may change. Changes to a subscription price follow the App Store's rules, including notice and, where required, your consent.

9. The beta

The TestFlight beta is pre-release software. It may have bugs, lose data or change without notice, so don't rely on it as your only copy of anything important. Apple's TestFlight terms also apply.

10. Changes

We may add, change or remove features. We'll post updated terms here with a new date, and for material changes we'll tell you in the app or by email before they take effect. If you keep using myFriday after that, the new terms apply.

11. Ending this agreement

You can stop using myFriday at any time by deleting the app (use Settings → Erase everything first if you want your data and key removed). We may suspend or end your access to online parts of the service, such as the Managed plan once it exists, if you break these terms. Your data lives on your device, so ending this agreement doesn't delete it; you can do that yourself. Sections that by their nature should survive, such as 12 to 14 and 16, survive.

12. Disclaimer

To the extent the law allows, myFriday is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that it will be uninterrupted or error-free, or that it will catch every mistake or unwanted charge.

13. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, or for charges your AI provider bills to your key, or for actions you take based on the assistant's output. Our total liability for any claim is limited to the greater of what you paid us for the app in the 12 months before the claim, or US$50. Some places don't allow these limits, so they may not all apply to you.

14. Indemnity

To the extent the law allows, you agree to cover our reasonable losses from claims caused by your misuse of myFriday or your breach of these terms.

15. Terms that involve Apple

  • These terms are between you and us, not Apple. Apple isn't responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for handling claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • We, not Apple, are responsible for investigating and handling any claim that the app infringes someone's intellectual property.
  • You confirm that you aren't in a country subject to a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law

The laws of the State of Texas govern these terms, without regard to conflict-of-law rules. [Placeholder: venue and dispute-resolution terms to be set by counsel.] Nothing here takes away rights you have under the consumer protection laws where you live.
